The Software, including its algorithms, technology, predictions, and content, is the exclusive intellectual property of SB TECH. No third party may claim any rights to the Software without written authorization from SB TECH.

3 User Rights & Restrictions

• Subhamoy Bhattacharjee / DestinyAI / SB TECH reserves the right to: Cancel, suspend, or restrict subscriptions or licenses immediately if any violation of these terms, fraudulent activity, or unauthorized modification is detected, or for crucial operational maintenance issues with reasonable effort to notify. Modify pricing, features, or terms at any time.
• Commercial Use: The Software is strictly for personal use only. Commercial use, resale, or redistribution of its predictions or content is expressly prohibited. Unauthorized monetization (e.g., reselling predictions, bundling with other services) is strictly prohibited and will result in legal action.
• All fees are non-refundable under any circumstances. Subhamoy Bhattacharjee / DestinyAI / SB TECH has no refund/return policy.

Output quality is contingent on the fidelity of classical texts and the absolute precision of user-provided birth data, for which you bear sole responsibility.

It is NOT a substitute for professional advice from qualified experts in medical, financial, legal, psychological, or any other field. You are solely responsible for your life decisions and actions.
• Assumption of Risk: You expressly assume all risks associated with the use of, or reliance upon, the Software's content. You waive any claim that you were misled regarding the nature or accuracy of the predictions.

5 Data Privacy & Protection: Zero-Retention Architecture

• Client-Side Processing & No Data Storage: DestinyAI does not store, collect, or retain your personal or financial data on our servers. Your birth details and astrological calculations are processed locally on your device and never transmitted to or stored by Subhamoy Bhattacharjee / DestinyAI / SB TECH.
• Payment Processing: Financial transactions are processed through secure third-party payment gateways. SB TECH does not receive or store your sensitive financial information. We may retain only transaction data necessary for order fulfilment and customer support (e.g., transaction ID, purchase date, email address).
• Ephemeral Server Interaction: Any communication with our servers is strictly limited to user authentication, license verification, software updates, payment processing facilitation, and anonymous aggregated usage statistics that cannot be linked to you.
• Website Context & Essential Cookies: While the DestinyAI desktop/binary software features a strict zero-retention runtime architecture on your local device, accessing and interacting with our web domain (https://www.talk2destiny.co.in/) inherently utilizes standard server logs and essential session cookies. These cookies are strictly operational and required by our third-party infrastructure and payment gateways (e.g., Razorpay) to maintain secure connections, authenticate checkouts, prevent automated cyber incidents, and facilitate successful transaction execution. Web traffic logs do not access or store your local astrological calculations or birth metrics.
• Your Data, Your Control: All personal data, birth details, and reports reside solely on your local machine. We cannot access, view, or recover your data. Your privacy is protected by design.

6 Third-Party Infrastructure & Service Availability

• No Control Over External Services: Subhamoy Bhattacharjee / DestinyAI / SB TECH does not own, operate, or control the infrastructure, policies, maintenance schedules, security practices, technical operations, or business decisions of third-party service providers. Consequently, Subhamoy Bhattacharjee / DestinyAI / SB TECH cannot guarantee the uninterrupted availability or performance of such services.
• Possible Service Interruptions: The availability, speed, responsiveness, functionality, or accessibility of DestinyAI may be affected by outages, maintenance activities, technical failures, cyber incidents, network disruptions, service suspensions, infrastructure migrations, force majeure events, or other circumstances impacting third-party providers.
• No Guarantee of Continuous Availability: While Subhamoy Bhattacharjee / DestinyAI / SB TECH makes reasonable efforts to maintain reliable service, DestinyAI is provided on an "as available" and "as is" basis. Subhamoy Bhattacharjee / DestinyAI / SB TECH does not guarantee uninterrupted, error-free, continuous, or always-available access to the Software.
• Limitation of Liability: Subhamoy Bhattacharjee / DestinyAI / SB TECH, DestinyAI, and its creator shall not be liable for any direct, indirect, incidental, consequential, special, or other damages, losses, delays, interruptions, data unavailability, or service degradation arising directly or indirectly from failures, outages, maintenance activities, policy changes, technical limitations, or any other issues attributable to third-party service providers.
• Right to Change Service Providers: Subhamoy Bhattacharjee / DestinyAI / SB TECH reserves the right, at its sole discretion and without prior notice, to add, remove, replace, migrate, or discontinue any third-party infrastructure provider, hosting platform, database service, payment processor, or other technology partner as deemed necessary for business, operational, technical, or security reasons.

7 Limitation of Liability

Subhamoy Bhattacharjee / DestinyAI / SB TECH is not liable for: damages (direct/indirect) from Software use/misuse; losses due to reliance on predictions; disruptions from force majeure (server failures, natural disasters); software updates may require user-side compatibility checks.

8 Governing Law & Jurisdiction

Governed by Indian law. This agreement shall be governed by the laws of India, with exclusive jurisdiction in the Barrackpore Subdivisional Court, West Bengal 700120, India for any legal disputes.

You irrevocably waive any right to initiate legal proceedings in any court, tribunal, or consumer forum outside of the Barrackpore Subdivisional Court, West Bengal 700120, India.
• Foreign Exchange, Gateway Fees & Conversion Rates: All cross-border transactions are finalized based on the Indian Rupee (INR) value at the moment of payment initialization. Subhamoy Bhattacharjee / DestinyAI / SB TECH is not responsible for foreign exchange fluctuations, bank conversion margins, or international transaction penalties levied by your card issuer or bank. In the event of an unauthorized international chargeback dispute, the user agrees to be liable for all merchant arbitration fees incurred by Subhamoy Bhattacharjee / DestinyAI / SB TECH.
• EU/UK Distance Selling & Local Esoteric Regulations Waiver: If you are accessing services from the European Union, United Kingdom, or jurisdictions with similar statutory consumer protections, you acknowledge that astrology is provided strictly as a spiritual/educational self-reflection tool. By using the Software, users unconditionally agree to this disclaimer and all terms herein, and waive all claims against Subhamoy Bhattacharjee / DestinyAI / SB TECH.

The advance consultation service fee is completely earned at that timestamp, and is strictly non-refundable and non-reversible.
• Phase 2: Separate Consent, Quotation, & Remedy Construction: The remedial proposals outlined in your diagnostic report are entirely elective. If you choose to acquire them through us, a separate cost is quoted based on material procurement, artisan labor, and scriptural preparation costs. By transferring the specified payment for the recommended remedies, you issue a separate, binding, and irreversible commercial mandate authorizing SB TECH to construct, engrave, or ritually consecrate your custom items. Once payment hits our accounts and manufacturing starts, the transaction is completely final. No cancellations or structural modifications can be facilitated.

They are legally classified as highly customized bespoke spiritual goods and intangible religious services under Indian law, which explicitly exempts them from standard consumer return policies or e-commerce exchange windows.

  • For Courier Shipments: SB TECH disclaims all liability for transit damages, component loss, package tampering, or structural delays caused by postal infrastructure handling. Any claims, transit disputes, or financial indemnities for broken or missing items must be initiated and negotiated by the client directly with the respective courier enterprise. SB TECH will provide tracking receipts to verify successful dispatch but will not offer replacements, refunds, or compensation for transit mishaps.
  • Mandatory Transit Damage Verification (Unboxing Video Requirement): To assist you with your independent claim against the courier company, you MUST record an uninterrupted, unedited, single-shot video of the package being unboxed. The video must clearly capture the unbroken courier outer seal, a fully legible shipping label, and the continuous physical process of opening the parcel. SB TECH can use this verified video footage to corroborate your claim against the shipping company, but it does not create any eligibility for a replacement item from SB TECH. Failure to supply this raw video verification to support@talk2destiny.co.in within 24 hours of documented delivery entirely limits our ability to provide claim data support.

VII No Liability

To the fullest extent permitted by law, Subhamoy Bhattacharjee / DestinyAI / SB TECH shall not be liable for any direct, indirect, incidental, consequential, or any other damages arising out of or in connection with the consultation, predictions, or remedies.

IX Governing Law & Dispute Resolution (Consultation)

These consultation terms shall be governed by the laws of India. Any disputes arising out of or in connection with the services shall be subject to the exclusive jurisdiction of the Barrackpore Subdivisional Court, West Bengal 700120, India.

X Provisions for International Clients & Cross-Border Consultations

For clients booking consultation services from outside the Republic of India, the following strict terms apply unconditionally:

• Aggressive Foreign Chargeback Protection: By completing your payment via any authorized cross-border payment channel (including but not limited to Razorpay International, direct bank transfers, or international digital wallets), you acknowledge that you are purchasing personalized, intangible spiritual guidance or customized products. You explicitly agree that this document will be submitted to your credit card company or merchant processor as definitive, binding evidence to immediately dismiss any unauthorized "friendly fraud" chargebacks or payment reversal requests.

For both, you accept that no method of transmission over internet is 100% secure.

✅ Entire Agreement & Severability

This document constitutes the entire agreement between you and Subhamoy Bhattacharjee / DestinyAI / SB TECH regarding both the DestinyAI software, personal consultation reports, and physical spiritual remedies. If any provision is found unenforceable, the remaining provisions remain in full force and effect.
